Washington State Divorce Timeline: How Long Does It Take?

Entering a divorce brings immediate questions about the future, primarily: “How long is this going to take?” As detailed in The Divorce Navigator by Mackenzie Sorich, understanding the legal roadmap can help you mentally and financially prepare. At View Ridge Law, our team helps you navigate each phase efficiently to protect your peace of mind.

The 90-Day Minimum and the 12-Month Reality

In Washington State, the absolute fastest you can get divorced is 90 days. You must wait 90 days from the date the petition is filed and served before you can present the final divorce papers to the court. However, the typical timeline for a domestic litigation in Washington is 12 months. Gathering information, negotiating, mediating, and envisioning your new life all take time.

The 7 Steps of a Washington Divorce

According to The Divorce Navigator, every divorce follows a specific seven-step sequence:

1. Filing Forms and Restraining Orders: Your attorney completes and files the mandatory divorce forms. In many counties, an automatic financial restraining order is issued immediately to establish a baseline and prevent the hiding or wasting of assets.

2. Serving the Papers: You must serve your spouse, or your spouse serves you. In an amicable divorce, the recipient can acknowledge receipt cooperatively without a formal process server, which saves time and money while preserving dignity.

3. The Response: The recipient has 20 days to formally respond to the petition, stating areas of agreement or disagreement.

4. Discovery and Negotiation: Both parties must exchange comprehensive financial documents. This phase can involve informal exchanges or escalate to formal interrogatories and depositions if one side is uncooperative.

5. Mediation and Settlement: Spouses negotiate disputed terms, often utilizing a mediator. Successful mediation results in a binding settlement agreement, often referred to as a CR2A contract.

6. Trial: If parties cannot settle their disputes, the case goes to trial. A judge will hear testimony and review exhibits to make a final decision, a process that can add significant time and expense.

7. The Final Divorce Order: Regardless of the path taken, a judge must sign the Final Divorce Order for you to be officially divorced.

Can You Speed Up the Process?

While you cannot bypass the mandatory 90-day waiting period, you can accelerate the rest of the timeline. The key is cooperation. An amicable divorce allows you to completely skip step six—the trial. Choosing cooperative service and openly agreeing to divide the work of gathering financial records makes the process much easier and more efficient.
