How We Help Families Navigate Adult Guardianship
The decision to pursue adult guardianship in Washington is rarely simple, often emerging during a point of significant family crisis, such as the sudden onset of severe cognitive decline. At View Ridge Law, our team is dedicated to easing the uncertainty and challenges of these transitions by offering practical solutions with a holistic outlook. We recognize that litigants are whole people who are part of complex family structures.
Understanding the Modern Legal Framework (UGA)
On January 1, 2022, Washington adopted the Uniform Guardianship, Conservatorship, and Other Protective Arrangements Act (UGA), codified as RCW 11.130. This moved the state from a model of removing rights to a surgical, rights-preservation model.
Guardianship vs. Conservatorship
The UGA bifurcates the traditional role of a “guardian” into two distinct categories. Guardianship primarily involves life choices regarding an individual’s personal care, health, and daily activities. Conservatorship is exclusively financial, managing property and assets. These roles can exist independently to ensure the “least restrictive” intervention.
Prioritizing Less Restrictive Alternatives
Our team maintains a strong preference for a Power of Attorney (POA) over court-ordered guardianship. A POA allows individuals to retain their independence and choice of agent while receiving support for financial and medical decisions. Guardianship is often enacted because a family waited too long to complete an estate plan; once capacity is lost, the window for a POA closes, making the court-supervised process under the UGA the only recourse.
How Our Team Guides the Petition Process
If a court arrangement is necessary, our team provides the skill needed to navigate this lengthy and expensive process. We assist concerned family members or friends in nominating themselves as guardians to support a loved one in need.
Navigating the Court Visitor Phase
The court will appoint a “Court Visitor” (formerly known as a Guardian ad Litem) to investigate the case. Because our team has deep community relationships, we know who the desirable Court Visitors are and can provide guidance on these critical interactions.
Defending Against Guardianship Petitions
Not every petition is brought in good faith. Our team is highly interested in defending individuals who are alleged to be incapacitated but believe they are competent and wish to maintain their autonomy. We provide the knowledge required to challenge unscrupulous parties and prove a respondent’s competence to the court.
Ongoing Support for Guardians and Conservators
Securing the court order is only the beginning. Once appointed, a fiduciary must fulfill specific reporting requirements to the court on an annual, biennial, or triennial basis. We provide significant support to existing guardians, assisting them with these mandatory filings and navigating changes in circumstances, such as moving a ward to a new facility.
